Many people use a driver’s license or other ID without giving it much thought. We carry it with us when we drive and show it if we get pulled over. We use it to get into a bar, board an airplane, or open a bank account. We use it to rent a car, pick up prescriptions, buy beer, claim a senior citizen discount, or check into a hotel.

Sometimes we have to show it to enter an office building or make a purchase using a credit card or check. In some places, like Alabama, we need it to cast a vote.

Unfortunately, Alabama is one of nine states that still demands proof of surgery from transgender people before issuing an accurate driver’s license. For many transgender people, gender-confirming surgical procedures are an important, necessary form of medical care. But not all transgender people need or want surgery, and others can’t afford to get the treatment they need. That means that in Alabama many transgender people have no ID they can use safely.

Today, the ACLU and ACLU of Alabama filed a lawsuit challenging Alabama’s policy of restricting access to driver licenses for transgender people that accurately reflect their gender identity. The government has no business dictating what treatment transgender people get, especially as a prerequisite for a basic government service. After all, it has nothing to do with how people drive.

For transgender people with IDs that do not match their gender, everyday experiences can become fraught with fear. Each instance of showing ID could lead to inconvenience, embarrassment, discrimination, or violence. In a 2010 report on transgender people in the South, Southerners on New Ground said that having ID with the wrong gender marker made transgender people afraid of calling the police and also made it harder for them to get jobs.

Darcy Corbitt, one of our three plaintiffs, thought she could leave that fear behind her after she changed the gender marker on her North Dakota license and U.S. passport. But when she moved back to Alabama for graduate school, the Alabama Law Enforcement Agency looked up her old records and refused to issue her a license that showed her female gender. For Darcy, that means staying in Alabama long-term is not an option. If she had to give up her North Dakota license and get an Alabama one under this policy, her safety and dignity would be compromised.

One of our other plaintiffs, Destiny Clark, has had to contend with Alabama officials seeking out ever more invasive information about her medical and surgical history, at one point even calling her doctor’s office without her consent to get detailed records. And even with all that information, Alabama still refused to change the gender marker on her license. As a result, Destiny has adapted her life to minimize her chances of needing to show her ID. Choices that many non-transgender people take for granted, like heading to a club with friends or going out for a drink, are off limits for Destiny.

According to 2015 research from the National Center for Transgender Equality, around a third of transgender people have experienced mistreatment after showing an ID that did not match their gender, most commonly verbal harassment or denial of services. Some — most commonly transgender women — were asked to leave an establishment after showing ID. Sometimes people were even physically attacked.

As with all forms of discrimination against transgender people, this problem does not affect all transgender people equally. Assault after showing ID that did not match their gender was twice as common for Black transgender people, three times as common for Middle Eastern transgender people, almost five times as common for Native transgender people, and almost eight times as common for undocumented transgender people, compared to transgender people overall.

In addition to endangering transgender people, Alabama’s policy — and other policies like it — violate the law. All people have a right to make their own health care decisions free from government coercion. They have a right to keep their personal information private. They have a right not to endorse a message from the government with which they disagree. And they have the right not to be discriminated against by the government for who they are.

Transgender people — like all people — deserve to live their lives without the government compromising their privacy, safety, autonomy, dignity, or equality. That’s why Darcy, Destiny, and other transgender Alabamans have taken this stand, and that’s why they should win in court.

The American Civil Liberties Union and ACLU of Alabama filed a federal law suit against officials of the Alabama Law Enforcement Agency (ALEA) for depriving transgender people of driver licenses that reflect their gender. The lawsuit states that the Alabama government has violated the privacy, due process, free speech, and equal protection rights of Darcy Corbitt, Destiny Clark, and a third, unnamed plaintiff.

Currently, transgender Alabamans may only change their gender marker on a driver license if they have had certain gender-confirming surgery. This policy makes it impossible for most transgender people in Alabama to obtain a license that they can use without sacrificing their privacy, safety, health, autonomy, and dignity.

Gender-confirming surgery is an important form of health care that many transgender people want and need. Many other transgender people do not want or need it, though—and some who do cannot afford it. Transgender people’s gender identities are valid regardless of what health care they have had, and the government has no justification for meddling in these personal health decisions. Most states and the federal government do not require surgery for changing the gender marker on identification.

People in Alabama typically need their license on a daily basis. Transgender people, unlike others, have to get by without one, or use a license that shows the wrong gender and so puts them at high risk of harassment and violence. That’s discrimination, and it’s wrong.

Update: On January 15, 2021, the district court ruled that Alabama’s refusal to issue accurate drivers licenses to our clients was impermissible sex discrimination and violated the federal constitution. While our clients have now been able to update their licenses, the state has since filed a notice of appeal to the Eleventh Circuit court of appeals.

Monroe Smith wanted the senators to understand that his gender transition was a long process and one that made him a success.

Speaking in opposition to a bill to ban medical treatments for transgender individuals on Wednesday, Smith, a senior at the Alabama School of Fine Arts in Birmingham, described a “slow and steady process” involving rounds of counseling and parental consultation before any medical treatments began. “Not once in this process,”

he said, “did he or his family ever feel pressured to engage in the treatments.”

“The focus of my evidence-based treatment was not to force anything on me or my family,” Smith told the Senate Healthcare Committee on Wednesday. “It was to facilitate my well-being, and offer me a chance to present to the world as I know myself.”

But the committee ultimately decided on a voice vote to approve a bill that would make recommending those treatments a felony, punishable by up to 10 years in prison.

The bill, sponsored by Sen. Shay Shelnutt, R-Trussville, would make it a Class C felony, punishable by up to 10 years in prison, for any person to prescribe medications like puberty blockers and hormones to those under the age of 19 and prevent surgery that alters a child’s sex. The bill would also require school counselors to not “withhold” information from parents about a transgender child.

Shelnutt and other supporters said that they were trying to protect children.

“They might go out of state for these surgeries, but we want to make sure that never happens to these children because there are lifelong consequences to these procedures,” Shelnutt said.

Opponents of the legislation said the bill showed a profound misunderstanding of gender dysphoria and medical care for transgender youth. Dr. Nola Ernest, a pediatrician who practices in Enterprise and Dothan, citing the risk of suicide among transgender youth, said many parents approached her for help.

“But gratefully, we know the use of medication for gender dysphoria under the guidance of a medical team is an evidence-based standard of care,” she said. “And it is often life-saving, not experimental.”

Quentin Bell, a nonprofit director who is a transgender male, said the Legislature should focus on improving education and health care in the state.

“If I have one request for you today is that you see transgender people, especially transgender youth, as members of your community, instead of making them targets,” he said.

Shelnutt’s bill is similar to one filed last year, part of a wave of anti-transgender legislation that Republicans pushed through State Houses in 2021. Shelnutt’s bill passed the Senate last year and almost came to a floor vote last year, but died on the last day of the session.

Gov. Kay Ivey signed a bill last year banning transgender athletes from playing sports of the sex with which they align.

The bill moves to the Senate.

A British doctor who used social media to defend trans rights could lose his job because of complaints about his posts.

Dr Adrian Harrop, a GP based in Liverpool is currently going through a Medical Practitioners Tribunal hearing regarding his conduct on his Twitter account, which he dedicated to speaking up for trans lives.

The tribunal, which started this week, is expected to run for the next three weeks. It could potentially end with Harrop being suspended or having his name erased from the medical register, making him unable to practise medicine.

Speaking exclusively to VICE World News ahead of the tribunal, Harrop said he believed he was the victim of an “organised and orchestrated” campaign against him by “gender critics,” however, he does regret using social media in the way that he did.

“I can achieve so much more by just being a doctor than arguing with anonymous people on Twitter,” he explained.

“I shouldn’t have wasted as much time and energy on that toxic platform as I did, but I still believe it is a genuine moral responsibility for privileged people to stand up for trans rights.”

The 34-year-old gay man splits his time between working as a GP for a practice in Liverpool, and working for CMAGIC, a gender dysphoria service which was set up by NHS England to cut down the waiting times for trans people who need medical support.

“We look after a huge number of transgender patients,” he told VICE World News. “I have well over 100 people who I supervise the medical treatment of, including gender affirming hormone therapy.”

While transgender healthcare continues to be debated in the UK, especially when it relates to people under the age of 18, Harrop is on the front line. This, he says, is why he felt the need to be so involved on social media.

“Doctors do have a powerful voice to share, and they should be able to use their voices to bring about positive societal change. What I didn’t realise is that on social media, everyone is under constant scrutiny, including by people who want to go against them in bad faith,” he says.

“The most foolish thing I did was to allow myself to get too drawn into a lot of fragile and vulnerable people arguing with each other.”

The General Medical Council’s guidance for doctors’ use of social media states: “You must make sure that your conduct justifies your patients’ trust in you and the public’s trust in the profession.”

It continues: “You must be prepared to explain and justify your decisions and actions… Serious or persistent failure to follow our guidance that poses a risk to patient safety or public trust in doctors will put your registration at risk.”

The tweets in question, which the General Medical Council received “hundreds of complaints” over, involve Harrop fighting back against online bullying, as well as him responding to transphobic statements, and retweeting pro-trans statements.

The witnesses and tweets involved in the case are currently being kept anonymous, but VICE World News was sent all of the material being discussed in the tribunal, including the full dossier of allegations, witness statements, and documents defending the doctor.

A Trans Woman Was Jailed With Men and ‘Viciously’ Beaten, Lawsuit Says

“From 10 May 2018 to 23 November 2019 you inappropriately used your Twitter account to post tweets that were offensive and/or insulting and/or inappropriate in nature,” reads the charges letter from the General Medical Council.

The letter goes on to list 15 charges against Harrop, all related to people holding “different views” to him “on transgender issues”. Among the charges are that Harrop used his Twitter account to “intimidate” critics by revealing information that could identify them.

“I am not transgender myself but I am a fervent supporter of transgender rights,” his defence statement reads.

“Strongly held views on both sides were being advocated via social media platforms including Twitter. I engaged in that debate… These sparring matches could be humorous or mischievous or aggressive and antagonistic,” he continues.

“A number of individuals and campaign groups whose ultimate aim, I believe, is to undermine, if not erase, the rights of transgender people deliberately chose to follow me on Twitter and to read and respond to many of my tweets,” he writes.

“They also made repeated complaints about me,” he adds, noting that some of them even “pretended” to be different people in their complaints to his superiors. Some encouraged others to do the same, even posting templates of what to write, and directly linking to his boss’ email address.

One woman who led the complaints against Harrop, who claims that the gay doctor bullied her online, tweeted that he is a “sick degenerate”, claiming “he and his ilk are a danger to children.”

The “journalist and broadcaster” goes on to claim that the work done by UK trans charity Mermaids is “child abuse”, and compares the organisation to “The Nazis”.

She continued: “If witch burning were still a thing the faggots would be piling up around me.” Facing backlash from her followers for using the offensive word, she claimed “it’s not meant as an insult to gay people though.”

The same woman promoted a petition against “Gay Pride at Disneyland” in summer 2019, claiming “LGBT is not for children”. The petition received 105,000 signatures in 24 hours, but the pride parade was not cancelled.

VICE World News has seen further evidence of social media users, some with over half a million Twitter followers, encouraging others to send abuse to Harrop, and to make official complaints against him.

In response to one of his tweets, a user posted a photo of a hand making a gun sign. They then deleted it, saying: “All I did was post a funny gif… Taken out of context I guess it COULD look like a death threat.”

UK Government Officials Held Secret Meeting With ‘Ex-Gay’ Conversion Therapy Providers

A tweet from February 2019 called Harrop “Baby Shipman” – referring to Harold Shipman, a doctor who is believed to be one of the most prolific serial killers in UK history – and a “snivelling shit”, before the user claims “Harrop has form. I’ve reported him to the GMC.”

A tweet from July 2021, targeting Harrop, explains to another Twitter user how driving “an extra ONE mph could literally kill someone” and to “think about who you want to run over”.

In October 2020, Harrop decided to close his Twitter account.

“The scale and intensity of the abuse, harassment and threats I have been receiving, both on and offline, has stepped up considerably in recent weeks,” he wrote at the time.

His tweet continued: “I am going to take a step back from Twitter for the foreseeable future, for the sake of my safety & sanity. I hope that I can just be left in peace”.

Harrop has not used Twitter since that day.

A professor who Harrop reported to during his postgraduate training gave a statement to the General Medical Council regarding Harrop’s behaviour online. She notes that following receiving “a number of complaints about Dr Harrop’s use of social media” she held two meetings with him in 2018 regarding his posts.

“I expressed my concern regarding the style and tone of some of Dr Harrop’s tweets and stated that I could understand why some individuals may feel that Dr Harrop was being aggressive,” she adds.

Today, Harrop is “deeply sorry” for the negative implications of his tweets, even in the face of extreme abuse, both then and now.

“I never imagined that I would give my regulator cause to investigate my fitness to practise during my career,” he says.

Asked how serious this tribunal is, Harrop told VICE World News: “It’s extremely serious – it’s the most serious thing that can be done to a doctor in this country.”

“Ultimately, the tribunal will be deciding whether what I’ve done and what I’ve said deems me unfit for practice as a doctor. If that’s the case, they could give me a warning, or a suspension. The worst thing that they can do is to strike someone off – effectively erasing them from the medical register – but I think the likelihood of that is virtually nil.”

Harrop is aware that some people will not understand why he cares so much about protecting the transgender community when he is not actually transgender himself. He has effectively put his career on the line for what he calls his “moral debt to the trans community.”

“I’ve been out and open about my life since I was at university, about 18 years old,” he said. “I learnt early that if you’re in a privileged position – which I am as a gay white cis doctor – you need to stand up for people.

“If people hadn’t stood up for the likes of me when we were little, fighting against really intense homophobia, there’s no way we could be so open and loud and proud now. That’s ultimately what I felt I was doing when I was doing this, and I tried my best to do that in the most effective and positive way possible.”

It is his long-held belief in equality, and his deep understanding of trans lives, that has led to Harrop being at the tribunal today.

“If it can happen to me on this issue, it could happen to any other doctor, commenting on any other important societal issue,” he warns. “Racism, climate change, whatever. People say things online because they believe they’re right – but if the debate shifts, they may come to regret it.”

Asked what he would like to say to the gender critics and transphobes who may read this, Harrop paused for a moment, before calmly and confidently responding, “you will not win”.

He continued: “I want them to understand that they make up a small minority of people who have extreme views. Although the battles you’re fighting on social media may seem like you’re winning, you’re not.”

Today, the doctor will start being cross-examined by the General Medical Council’s barrister, based on the evidence and statements that have been collected. Harrop told VICE World News he feels “nervous – as anyone would be in this sort of situation”.

He continued: “Ultimately, I’ve been entirely honest and transparent about everything, and I have nothing to hide. It’s now my opportunity to give my side of the story, and it is a relief to be able to finally get it out there and on the record.”

Britain’s Equalities Watchdog Met Privately With Anti-Trans Groups
Exclusive: Leaked emails and documents obtained by VICE World News show how senior leaders at the Equality and Human Rights Commission worked to erase trans rights.

Senior leaders at Britain’s equalities watchdog have worked to erase trans rights via the courts and held private meetings with anti-trans groups, leaked emails and documents obtained by VICE World News reveal.

VICE World News has obtained documents revealing leaders at the Equality and Human Rights Commission (EHRC) as being key players in removing rights from trans people, through supporting legal cases that opposed trans equality.

The commission’s executives have also organised multiple private meetings with anti-trans lobbyists over the last year, the emails and documents reveal.

The EHRC was established in 2007 by the then Labour government to monitor human rights in England, Wales and Scotland, and to enforce equality laws based on protected characteristics, such as sexuality, gender reassignment, race and religion. Although not part of a government department, the EHRC is a public sector organisation funded by the taxpayers, whose senior leaders are appointed by the government. The organisation’s “vision and purpose”, which is embedded in staff email signatures, says it is committed to standing up for “freedom, compassion and justice.”

However, emails and documents obtained by VICE World News, some via Freedom of Information Act requests, show current leaders of the EHRC appear to hold views about trans people and gender identity which completely contradict this.

Asked about our findings, a spokesperson for the commission said: “We exist to protect, enforce and promote equality and human rights laws for everyone, including trans people.”

Equality campaigners have previously complained about the organisation being “too politicised” because the commission’s most senior leaders – also known as the commissioners, or board – are appointed by the minister for women and equalities, a role currently held by Liz Truss.

In December 2020, Truss – who is also UK Foreign Secretary and a potential successor to Boris Johnson as prime minister – appointed Baroness Kishwer Falkner as chair of the EHRC, which is the most important role in the organisation. Falkner also serves as a non-aligned member of the House of Lords.

Documents provided to VICE World News by researchers at trans rights organisation Steph’s Place reveal a number of controversial meetings were arranged with the EHRC following Falkner’s appointment.

Nicola Williams, founder of Fair Play For Women, a group that claims to “advocate for the sex-based rights of women and girls”, was invited to meet with Falkner. Williams has been accused of transphobia for repeatedly calling trans women “males”.

Williams notes in one email, “With a new Chair installed, I hope this can be a moment for change.”

Suddenly switching to her parliament email address, rather than her EHRC email address, Falkner sent Williams a message on the 22nd June, 2021 with the title “Can we have a telephone conversation?” The women then exchanged phone numbers.

VICE World News asked four leading LGBTQ organisations that support trans rights whether they were given this same opportunity for direct contact with Falkner in her role as EHRC chair – they all said they hadn’t.

Just last week, the EHRC released two controversial statements which received a huge backlash from LGBTQ groups.

One statement called for the Scottish government to delay its work updating trans equality laws, and the other requested the upcoming conversion therapy ban in England and Wales to not cover trans people.

Stonewall called the statements “an attack on trans equality”, and the charity created an open letter in support of trans rights, which has now been signed by over 5,000 people.

Another of the appointed leaders of the EHRC is Alasdair Henderson, a barrister who has played a key role in erasing trans rights.

In 2020, Henderson represented Keira Bell, a young woman who regretted transitioning. Henderson challenged the NHS’ use of puberty blockers, claiming that young people cannot consent to using them. As a result, the NHS had to remove all medical treatment options from trans young people, until the decision was overturned nearly a year later.

The leaked documents appear to show Henderson’s long-term influence over his colleagues on the EHRC board, and therefore his influence over the organisation becoming more critical of trans lives.

In April 2021, the EHRC received a huge backlash from LGBTQ people and their allies for suddenly jumping to the defence of a “gender critical” woman in a major legal case. Maya Forstater claimed she lost her job because of her belief that trans women are not women. Assistance from the EHRC helped to close the case in favour of “gender critics”, and the case was celebrated by people who hold transphobic views.

Through documents released through the Freedom of Information Act, VICE World News has learned that Henderson was the employee who first suggested to “intervene” in the Forstater hearing.

This was confirmed through an email following-up on a conversation in a board meeting the day before.

Asked if this was correct, the EHRC responded: “The suggestion to intervene in the case was made by one of our Commissioners, Alasdair Henderson.” However, it adds, “the decision to intervene was ultimately approved by Commision Board members and the Chair, Kishwer Falkner.”

In an online profile, Henderson describes himself as a Christian who would “strongly defend freedom of religion and belief, freedom of conscience and freedom of speech for everyone.” He has previously been criticised for liking and retweeting social media posts criticising Black Lives Matter protesters, and describing the words misogynist and homophobe as “highly ideological propaganda terms”.

The leaked emails obtained by VICE World News also show that some senior staff in the EHRC policy teams were not aware of Henderson’s involvement in the case against the UK’s gender identity service for young people.

The massive legal case stopped the NHS from providing transgender healthcare to under 16s in the UK, and caused lasting damage to trans rights globally. Henderson was partnered with Paul Conrathe, a Christian lawyer known for legal attacks against abortion, contraception and LGBTQ rights.

After the NHS eventually won the case, allowing trans young people to continue with their gender care, Conrathe said he was “dismayed” and “surprised”, calling services offered by the NHS Gender Identity Development Service “poorly evidenced treatment with lifelong irreversible consequences”.

The day before the conclusion of the case made international news, one EHRC communications official wrote, “Alasdair Henderson, one of our Commissioners, is one of the barristers challenging the Tavistock. Were we aware that he was this involved in the case?”

Being passed up the chain, another staff member wrote, “Please see email below. Are we aware of this connection?”

The pack of leaked documents show, on at least two occasions when discussions about transgender people were held by the board, Henderson appeared to flag that he had a “potential conflict of interest” because of his legal work. However, the board still allowed him to continue participating in the discussions.

The emails reveal further evidence of the EHRC becoming more critical of gender identity over recent years.

Documents show that Kate Harris and Bev Jackson – founders of the “gender critical” LGB Alliance – have held meetings with people at the top of the EHRC since Falkner took over as chair.

In February 2021, the founders were personally invited to participate in a briefing session for the board on “issues relating to trans people” by Melanie Field, executive director of strategy, police and Wales at the EHRC. The other organisations invited were Stonewall – Europe’s largest LGBTQ charity, and Williams’ Fair Play For Women. No other groups were invited to participate.

“Apologies to email you out of the blue,” someone from the EHRC wrote to the LGB Alliance – the sender’s name was redacted. “I have a time-limited request which I wondered if you would be able to help with.”

They continued: “I know you have been in contact with colleagues at the Commission and will soon be meeting with Melanie Field. She has asked me to contact you to enquire whether you would be able to provide a short three minute video outlining LGB Alliance’s main policy positions and why you think it is important to separate trans and LGB issues, for us to share with our board at tomorrow’s session.”

Field then sent an email thanking the founders of LGB Alliance.

“I’m really keen that our Board gets a balanced picture of the different issues being raised in this debate,” she wrote.

In the video produced by LGB Alliance, seen by VICE World News, the founders of the organisation call transitioning “horrifying”, adding, “it leads to a life of infertility, loss of sexual feeling, continuous medication and appalling surgery. We’re so glad that we were not growing up in this kind of ethos which we have today.”

Discussing how the NHS is carrying out “medical experiments on children”, they add: “We don’t need to go into much detail about that because Alasdair Henderson, on your board, will be able to explain all about it.”

They continue: “We represent thousands and thousands of lesbians, gay men and bisexuals, who don’t hold to this belief in gender identity. Unfortunately, all the other LGBT groups do, so it’s really important that we get representation and that our views are heard whenever anything about LGBT issues is being discussed.”

Three months after the board briefing, the EHRC controversially removed itself from Stonewall’s Diversity Champions programme – a corporate diversity scheme which helps organisations to support their LGBTQ employees.

Asked why gender-critical groups were invited to speak with the EHRC, but no trans-led organisations were, an EHRC spokesperson said: “We hold regular discussions with a full range of interested parties on all areas of our work.”

Just over a year ago, Falkner’s predecessor as EHRC chair David Isaacs warned that the equality watchdog was being used as a political tool. His criticism came after Truss announced the EHRC’s new chair and commissioners who would “drive [her] agenda forward” and “challenge dangerous groupthink”.

In an interview with the UK’s Guardian newspaper, Isaacs said: “My view is that an independent regulator shouldn’t be in a position where the governments of the day can actually influence the appointments of that body to support a particular ideology.”

The UK’s biggest trans and LGBTQ organisations have repeatedly called out their “frustration and disappointment” at the EHRC’s failure to protect LGBTQ people’s rights – and trans people’s rights specifically.

In May 2021, leaders from 40 leading LGBTQ charities signed a public letter stating: “The EHRC has driven forward very little for our communities in recent years… We are frustrated that you chose to intervene in a case to say that so-called ‘gender critical’ beliefs should be a protected philosophical belief.”

They ended the letter with “It’s time to step up”, however, the EHRC has become significantly more critical of LGBTQ rights since then.

In response to last week’s EHRC statements on LGBTQ rights, LGBTQ charities and organisations have been publicly questioning how the EHRC can continue to operate.

Liberty, a human rights campaign group, said the EHRC’s status as a national human rights institution needs to be “reviewed”. Stonewall echoed this, saying the EHRC had betrayed LGBTQ people.

An EHRC spokesperson said: “We are an independent statutory body with a specific responsibility to ensure equality across the nine ‘protected’ characteristics of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion and belief, sex and sexual orientation. Sometimes this means balancing rights, and we understand that this issue in particular evokes strong views.

“As we have said, the current polarised debate is causing much harm and distress to people on all sides. Everyone’s concerns should be discussed and addressed carefully, openly and with respect, to avoid further damage and division.”

Trans people in Britain would be excluded from single-sex spaces unless they possess a Gender Recognition Certificate (GRC) under unpublished guidance from the Equality and Human Rights Commission (EHRC). GRCs are currently held by as little as 1 percent of trans people in the country.

VICE World News has been leaked sections of an unpublished guidance pack dated from the end of 2021 from Britain’s equalities watchdog, which advised businesses and other organisations such as shops, prisons and gyms to “protect women” by barring most trans people from their single-sex spaces, including toilets, wards and changing rooms.

A trans person looking for legal recognition of their gender identity currently requires medical assessments and psychiatric interviews in order to “prove” their gender and receive a GRC. Non-binary identities are not recognised in UK law.

According to the leaked EHRC guidance, a trans person should be barred from accessing spaces matching the gender they’re living as, unless they hold a GRC. But official data estimates only 1 percent of trans people in the UK currently have one.

Baroness Kishwer Falkner, the chair of Britain’s equalities watchdog wanted workplaces and businesses to “exclude trans people” from these spaces to “protect women’s rights”, VICE World News was told by ex-EHRC staff members.

The guidance was due to be released last month but has not yet been published.

Whistleblowers told VICE World News that Falkner was “furious” about UK department store John Lewis adopting gender neutral fitting rooms in April 2021 and had subsequently “pushed for the EHRC to adopt a totally gender critical position”.

“Falkner was furious about John Lewis ‘letting down women,’” one ex-staffer said. “She was being transphobic… The team just wants to exclude trans people more,” said another.

Asked detailed questions about our findings, a spokesperson for the EHRC didn’t respond to any specific points. They didn’t confirm or deny whether trans people could soon require GRCs to access single-sex spaces.

They said: “We acknowledge that some EHRC staff have been unhappy, which we regret, and we are working hard to explain decisions and why they are in line with our statutory responsibilities.”

“Sex and gender reassignment are legally protected characteristics under the Equality Act 2010, as are seven other characteristics. The Human Rights Act 1998 protects all rights in a balanced and proportionate way. These are the laws that the EHRC upholds impartially and we totally refute your insinuations of bias in the areas you mention.”

VICE World News has previously reported that staff are leaving as a result of an “anti-LGBT culture” being adopted at the organisation, since a change of the government-appointed leadership team last year.

Staff Are Quitting Britain’s Equality Watchdog the EHRC Due to ‘Transphobia’

Responding to the reporting, Crispin Blunt, a Conservative Party MP and chair of a UK Parliament oversight group for LGBTQ rights, described the EHRC’s work as a “direct assault” on the rights of trans people in the UK.

The UK currently has some of the most restrictive gender recognition processes in Europe, as a result of the 2004 Gender Recognition Act. However, all trans people are currently protected from discrimination by the UK’s Equality Act, and they do not need to have undergone any specific treatment or surgery to be protected.

While the way these laws intersect has been the subject of intense and frequently toxic debate in the UK, several other countries have successfully implemented progressive policies which support trans people.

The unpublished guidance shows a radical shift from previous advice given by the EHRC.

It is unclear how the EHRC expected organisations to enforce the policy on trans people needing to hold certain legal documents to access facilities such as bathrooms, but a current EHRC policy worker said “the leadership team aren’t worried about that, they just want organisations to know that they won’t be sued for being transphobic.”

Staff members – who are working their notice periods – told VICE World News they are “scared” the guidance would have led to “customers reporting people for looking too manly or womanly”.

The EHRC was established in 2007 by the then Labour government to monitor human rights in England, Wales and Scotland, and to enforce equality laws. Although not part of a government department, the EHRC is a public sector organisation funded by the taxpayer, with senior leaders appointed by the government.

Falkner has previously described the EHRC as “a regulator with compliance enforcement powers”. The current single-sex spaces guidance is significant because organisations across the UK have been asking for help to provide legally-sound facilities.

The Good Law Project campaign group provided another document to VICE World News, confirming that the EHRC’s current leadership team now wants GRCs to be key to accessing single-sex services.

Jo Maugham, director of the Good Law Project campaign group, said: “What the EHRC is reported to be proposing is straight up unlawful. The Equality Act protects all trans people – not just those with a Gender Recognition Certificate. Guidance in that form would not survive legal challenge.

“This guidance as reported would mean a trans man who has lived as a man for years, and may have gone through medical treatments and operations to affirm his gender, should be using the women’s toilets if he does not possess a GRC.”

Ex-staff members told VICE World News that in April 2021 Falkner pushed staff to speak to John Lewis about its trans-inclusive policy on fitting rooms, following complaints sent to the EHRC by “gender critical” groups.

Asked what the tone of the chair’s request was, the staff member replied: “Well she certainly wasn’t congratulating John Lewis on their trans-inclusive policies. She was being transphobic.”

“Any time Falkner saw gender-related things she wanted to get involved in, she would send an email to [senior leaders at the EHRC], and they would forward it on and loop others in.”

Another ex-staffer recalled the same John Lewis incident: “I was completely flabbergasted. Our leadership team had completely disregarded all of the legal advice they’d been given on GRCs and the Equality Act, and I couldn’t believe what Falkner was trying to do.”

They added that the EHRC’s legal expert on this topic has now left, and moved to “a human rights organisation that actually cares about LGBTQ people”.

The ex-staff members said that they eventually changed Falkner’s mind, asking her to wait to contact the department store chain until the EHRC’s “new position” on single-sex spaces was ready. VICE World News contacted John Lewis, who confirmed that the EHRC had not reached out to them about their fitting room policy.

In 2020, the former CEO of the EHRC, Rebecca Hilsenrath, stated that the laws which allow organisations to treat trans people differently “do not hinge on whether the trans person has a GRC or not.” She added: “To provide reassurance on this important point, we have written to the Equalities Minister, Kemi Badenoch MP.”

In the same release, the former leader reiterated that there is “no reason” why simplifying the way trans people are legally recognised should lead to “the removal of single-sex services or women-only spaces”.

However, a year later – in an interview on the BBC Radio 4’s Woman’s Hour programme – Falkner completely disagreed with this. She discussed a theatre trip where she came across gender neutral toilets, saying: “I discovered that there was no single-sex space for women other than one toilet right in the rafters, very far away from where the seating was.”

“There is this sort of loss of women’s toilets and women’s facilities,” she added, “things that used to be there that aren’t any longer there.”

Describing the guidance that she hoped to release in January 2022, she said: “All we’re going to do is explain in practical terms, to different kinds of businesses and institutions, public and private institutions, what the Equality Act actually says about being able to – in this case – discriminate in favour of women.

“We’re hoping that all we need to do is point out what the law says. We’re hoping that organisations will draw their own conclusions on that. It’s a nudge rather than a hammer.”

Blunt, the Tory MP, said: “It does now appear the rights of trans people are under direct assault in the UK from the public body they would, until now, have expected to be most steadfast in their defence.”

He added: “Baroness Falkner should reflect seriously on the effect of her decisions to date on this most vulnerable group, and bring them back to being consistent with evidence. She should also not underestimate the breakdown in trust and confidence in her leadership within her organisation, as it is her officials whose evidence and advice is being discounted.”

Bloomington family fights for transgender daughter amid bill banning her from girls’ sports

Around the time Kirin Clawson turned 2, she began refusing to leave the house if she wasn’t wearing a tutu. She would throw a tantrum if she was only wearing her boy clothes.

When her parents, Beth and Nathaniel Clawson, saw that she felt more herself in girl clothes, they went out and bought her a pair of “Frozen”-themed shoes from Smith’s Shoe Center that she never took off.

By the time she was 3, Kirin was living as her true self. She started transitioning in preschool, which involves using correct pronouns and buying clothes she feels comfortable in.

Now, she’s a 9-year-old transgender girl in third grade at Childs Elementary School. She’s outspoken, precocious and funny, and she does roller derby, plays volleyball and is a heck of a swimmer, Beth said.

Kirin has always been accepted by her classmates and family. But the Indiana Legislature continually attempts to pass laws that tell her she doesn’t belong.

What’s in House Bill 1041?

The Indiana House passed a bill, HB 1041, last week banning transgender girls from playing sports in elementary, middle and high schools. It passed 66-30 and is now in the hands of the state Senate.

The bill’s author, state Rep. Michelle Davis, R-Whiteland, said the bill is about ensuring girls’ athletics remain fair, as transgender girls could have a physiological advantage over cisgender girls.

The Indiana High School Athletic Association already has a policy that requires transgender girls who want to play sports to show they’ve undergone hormone treatment for at least a year and that their muscle mass or bone density is in line with other girls their age.

The bill has been adamantly opposed by the ACLU, which has said it will fight the bill in court if it is signed into law, as well as members of the LGBTQ community and parents of trans children.

Nathaniel, who testified at the Statehouse last week, is one of them.

He spoke about Kirin and how she won’t go through a testosterone-rich puberty. How her peers have seen her as a girl for as long as they’ve known her. How she’s only ever seen herself as a girl.

“There are so many life lessons that kids learn through sports, and they build stronger friendships with their peers,” he said. “It’s those life lessons that I was worried most about my daughter missing out on.”

Standing up for herself

As Kirin’s gotten older, she’s learned to stand up for herself and take up the space she deserves, Beth said. But earlier in her daughter’s life, Beth was hesitant to put her in sports with other girls in fear of what they might say to her.

“I discouraged her interest in things, specifically in swimming and gymnastics, because it’s leotards and swimsuits,” she said. “Of course, we as a family now know that gender has nothing to do with body parts, but a lot of the world doesn’t understand that.”

Beth said she understands all kids should get the opportunity to compete in fair competitions, but banning transgender girls from participating in girls’ athletics would cause much greater issues.

“My daughter’s mental health and wellness is far more important than your child’s medal or record,” she said.

In 2020, 52% of transgender and nonbinary people in the U.S. seriously contemplated killing themselves, according to an annual survey from the Trevor Project, a national nonprofit focusing on suicide prevention in LGBTQ youth. The survey is based on the experiences of nearly 35,000 LGBTQ people aged 13 to 24 across the country.

Bloomington, specifically Childs Elementary, has always been accepting, Beth and Nathaniel agreed. The day after Nathaniel testified at the Statehouse, Kirin’s teacher allowed her to carry her transgender pride flag all day and give a presentation to her classmates about what it means to be transgender. Every year, Kirin comes out to her class — mostly the same students she’s been with since kindergarten — because she feels she needs to and is comfortable doing so.

Some proponents of anti-trans legislation have argued kids can’t develop gender identity at such a young age and that parents of transgender children are mutilating them. If those people were able to see Kirin and how happy she is in her body, Beth said, they might not feel the same.

Developing an identity

When Kirin was young, Beth and Nathaniel started requesting letters from her pediatrician confirming that she is being cared for and not mistreated. They keep a binder of the letters, so that if social services or anyone else questions if Kirin is living with a safe home life, they have evidence.

And even if Kirin does decide one day that she isn’t transgender, Beth and Nathaniel won’t have any regrets.

“Our whole thought process is if she changes her mind, she’ll at least know that we accepted her and we love her,” Nathaniel said.

The Clawsons are involved with a local group called TASC, the Trans and Allies Support Community, through which they met Jeanne Smith, a longtime Bloomington resident. Smith and the Clawsons talk about once a week, Beth said.

Smith, 69, has known she was transgender since she was 5. She spent her life hiding her true identity until she was 55.

“I spent 50 years trying not to be trans until I realized that I had a soul,” she said.

Smith said if transgender girls are banned from playing girls’ sports — and if other legislation that is harmful to the transgender community becomes law — it would instill fear in transgender youth and could cause them to hide their identity like she did.

“The state of Indiana is doing nothing to help the trans person,” she said. “They’re putting them in the worst possible situation.”

“We spend our days armored up,” Beth said. “A lot of people are saying, ‘We’re not denying your child because they can still play boys’ sports.’ But I’m like, you can’t tell them, ‘Be who you are, except when.’ You have to let our kids be who they are all the time.”

At least half a dozen bills were filed at the beginning of Indiana’s 2022 legislative session that involve transgender people. Other bills included banning affirming medical care for minors, limiting which bathrooms transgender people could use and not allowing gender to be changed on a birth certificate. Although they’re less likely to pass, Nathaniel said, it still hurts to see those bills filed.

Beth, Nathaniel and Jeanne, who are all heavily involved in the local transgender community, said they don’t know of any other transgender girls in this area who are participating in sports right now.

As long as they have Kirin, though, they’re going to fight for her.

“We spend our days armored up,” Beth said. “A lot of people are saying, ‘We’re not denying your child because they can still play boys’ sports.’ But I’m like, you can’t tell them, ‘Be who you are, except when.’ You have to let our kids be who they are all the time.”

FAKE TRANS DOCUMENTARY/ORGANIZATION:

Here’s the ridiculous story about how extreme the far-right is willing to go to dehumanize trans people. I was nearly tricked into doing an elaborate anti-trans documentary by Matt Walsh’s film crew this month. It started with an email from the “Gender Unity Project” a couple weeks ago. They claimed they were doing a film on the trans community and gave me names of well-known trans individuals and surgeons they had interviewed. It all seemed normal at first. I even talked to the producer (Makenna Lynn Waters) on the phone beforehand. She sounded like a well-meaning cis film graduate who was just curious about the trans community.

When we chatted, she claimed the documentary was self-funded. I was suspicious because she had finished college recently, but figured she was just rich (who has that kind of money?). Later, she told me the individual they were interviewing in Chicago had suddenly canceled (this happens, but is still sus). Then she offered to fly me to Nashville: where Matt Walsh lives. They finally sent me a release form this morning, which strangely didn’t have the name of the company on it. So, I looked up the Gender Unity Project. It used a registered agent to shield the company owners. It’s dubious but sometimes registered agents simply make it easier to incorporate. Then I looked Makenna Lynn up. Her name didn’t show up anywhere.

After some heavy Google searching, I realized she used her middle name as her last in our emails. I found the IMDB page of her real name (Makenna Waters). It turns out she’s a producer for the Matt Walsh show! That’s not a red flag: that’s a gun to your face. If you’re not familiar, Matt Walsh is a white supremacist who makes a living denying the basic humanity of trans people. She wasn’t just a producer for his show: she worked on over 200 episodes of it! I finally found her Twitter, which features videos of Walsh berating protesters and Ben Shapiro doing his usual BS.

I decided to look closer into the “Gender Unity Project.” After searching its state registration number, I learned it was registered to Justin Folk, a white supremacist documentarian who works for Matt Walsh and Prager U. His initials (jrkfolk) were also listed in the release I thankfully refused to sign. So, if you’re contacted by these slimy assholes, don’t respond. The last thing we need right now is another “gotcha” anti-trans documentary! Stay alert and take any media personalities with a grain of salt.

And they say we’re the ones tricking people?

Trans adolescents should decide when to start gender-affirming care, not parents or courts

What is it about?

Debates around access to gender-affirming care often focus on whether clinicians should offer transition-related medical interventions to adolescents, and little attention is paid to the question of who should make the ultimate decision to accept or reject the intervention once it is offered. This issue has, however, come up in court cases—with those opposing gender-affirming care frequently arguing that adolescents can’t validly consent to it.

This paper takes on the question by drawing on the idea of subsidiarity, from political philosophy. Subsidiarity is deceptively simple. The most impacted, lowest-level person or group—such as the adolescent being offered medical care—should make the decision by default, and more ‘distant’ people like parents and courts should only get to make decisions if their input is necessary to making a satisfactory decision.

Applying subsidiarity, my paper argues that youth should usually get to make that decision even when they don’t have full capacity to consent because parents and courts are worse placed to make the decision. Parents and courts are typically given authority to make decisions because of the assumption that shared values and considerations can be used to make them—which is often right. But the uniquely personal, intimate nature of gender makes it nearly impossible for them to have a good sense of what it’s like for the adolescent to delay care. The adolescent typically remains the ‘best’ decisionmaker even when they don’t have full capacity to consent. The paper develops a framework for ascertaining when adolescents should and shouldn’t get to make that ultimate, legal decision and concludes that it’ll be rare for parents or courts to be better positioned to decide.

Why is it important?

While social media debates often focus on the morality and scientific grounding of gender-affirming care, debates around capacity to consent often pose the greatest risk for court restrictions on access to gender-affirming care. We saw it in the English decision Bell v Tavistock, and similar arguments were attempted—unsuccessfully thus far—in Canada and Australia. A judge’s conclusion that parental or court approval is needed can delay access to care by months or years and create hierarchies between adolescents who have parental and financial support and adolescents who don’t. It’s important to develop scholarship that can speak to these legal aspects, developed in a language that is legible to courts tasked with making decisions.

Another reason my paper is important is that it doesn’t focus on whether trans adolescents usually have the maturity or insight that attracts full capacity to consent. I grant that some may not have full capacity to consent, and instead focus on what we should do in those cases. That’s very important to me, because there are trans adults who will never be considered to have full capacity to consent by the legal system due to their disabilities. There are also youths who are maybe less mature or supported yet need gender-affirming care for wellbeing and as a matter of self-definition and autonomy. Our scholarship needs to serve all trans people, not just those who accord with dominant, oppressive standards of medical capacity. Although I focus on adolescents, my paper is also a major contribution for adults with developmental disabilities and mental illnesses that undermine capacity to consent as understood by courts. I hope that it will contribute to greater access to gender-affirming care for them as well.

A trans 13-year-old has been left too terrified to leave his home after months of relentless bullying.

Riley Rogers lives in fear of the physical and verbal harassment he faces when leaving his home in Denton, Manchester, and of the cyber-bullying he faces when he scrolls on his phone or opens his laptop.

In yet another example of Britain’s slow slide back into anti-LGBT+ hostility, Rogers began facing a wave of threats from his 13th birthday last November.

Now, he’s too scared to leave his home and hasn’t been to school in days. When he does attend, he brings a cuddly toy with him for protection, he told Manchester Evening News.

“I can’t really go outside anymore without anyone,” he said to the local newspaper. “For the past two days, I’ve had to bring a teddy bear to grab onto.

“I’ve not been great at all. I’ve been really upset and haven’t been to school a lot. I was a little bit angry, to be honest.

“I didn’t do anything. I was really upset.”

Mum left to watch helplessly as ‘brave’ trans son squares off against school bullies

On 31 January, Rogers left an after-school LGBT+ club and sat outside an Aldi supermarket by Crownpoint Shopping Park.

There, a group of students snatched and destroyed his bag and threatened to hit him with plastic crates. One of the bullies even recorded the ordeal on their mobile phone.

He and his family reported the incident to the Greater Manchester Police force.

Such torment is common for Rogers. Bullying that was once constrained to the internet has spilled out onto the playground: other children have struck him with their backpacks and torn up his planner and threw it out the window.

The attacks have left Rogers’ family furious. His mother, Sarah Rogers, has been left feeling helpless. She says Denton Community College, where Rogers is a Year Eight pupil, does little to clamp down on the attacks.

“It’s been absolutely horrified if I’m being honest,” she said. “No one around checked Riley was okay. ”

Sarah said her son knows that not everyone in his life is going to accept him. He reintroduced himself to the world as trans when he was 11, she explained. Now she has seen her child be “constantly picked on”.

“I’ve watched my child be so brave,” she said, “dealing with people’s reactions.”

The bullying Rogers has faced is just one example of the rising tide of anti-LGBT+ discrimination in Britain.

Anti-LGBT+ hate crime has soared in recent years, with at least 19,679 crimes motivated by hatred for someone’s sexual orientation taking place between 2020 and 2021, according to police figures.

This was part of a wider increase of 210 per cent in LGBT+ hate crime and harassment between 2014 and 2021.

But the number is likely far higher than the official figures show. Nine in 10 queer victims do not report the incident to the authorities, per government figures.

Only recently did one of the world’s top human rights organisations, the Council of Europe, brandish Britain as well as Russia and Poland for their “virulent attacks” against LGBT+ rights.

Diplomats brought attention to the nation’s mishandling of trans rights in a committee report. Trans people are routinely dehumanised and demonised by the mainstream media as life-saving legal reforms are scrapped and the nation’s equality watchdog recommends that the government delays banning trans conversion therapy.

“The significant advances achieved in recent years are today under threat,” the Council of Europe concluded.

“It is crucial to react quickly in order to prevent further backsliding and work actively to promote full respect for the rights of LGBTI people.”

The GENECIS children’s gender clinic in Dallas, TX, was recently shuttered. We’ve been trying to get OpEds by parents of trans youth and trans-affirming providers — people actually in Texas — placed in Texas media for months. The Dallas Morning News is one of the papers who has rejected those OpEds time and time again.

But they’ve just published an OpEd by Stella O’Malley, a well-known TERF from Ireland who rejects the affirmative model of care.

In her piece, she cites Laura Edwards-Leeper and Erica Anderson, calls stats about suicide risk “shaky,” says “pronouns are an unknown entity altogether, with little research on what changing them means,” warns about comorbidities and that these kids might just be gay. She also points to recent changes in “trans-friendly” jurisdictions like Finland, Sweden, Australia, and New Zealand for limiting medical interventions (or recommending those limitations) for people under 18 or 25.

Dr. Gina Sequeira first saw the protesters on a bright clear morning last September. A co-director of Seattle Children’s Gender Clinic who provides gender-affirming care to young people, Sequeira had confronted ignorance about her medical specialty in the past. But nothing had prepared her to see people outside her office, waving signs and handing out flyers warning of the “dangers” of the work she does.

“That was really, really hard for us as a clinic,” she says. “And I think it was really hard for the hospital’s patients and families who witnessed it.” Just a month later, protesters showed up again.

Hers wasn’t the only clinic having a hard time in 2021. The LGBTQ advocacy group Human Rights Campaign has calculated that, last year, conservative lawmakers introduced over 130 anti-trans bills into state legislatures—including 35 that explicitly limited the ability of trans and gender-expansive youth to access gender-affirming care, a term that refers to holistic psychological and medical care that affirms a person’s gender identity. As of Feb. 11, the ACLU has tracked similar bills in at least 17 state legislatures this year.

Only a small group of pediatricians provide such care in the U.S., and, in this political context, those who do are often finding themselves at the receiving end of growing harassment—even as research confirms the potentially life-saving nature of the work they do. Demonstrators have organized protests like the ones at Sequeira’s clinic at other sites across the country; in Ohio, billboards have been rented spreading disinformation about affirming care—including one near a children’s hospital. Pediatricians tell TIME they have received threatening mail, have been impersonated online and have feared for their safety. And they worry such harassment campaigns could have a devastating impact on the ability of young people to access crucial medical care.

Roughly a month before the September protest, Sequeira had received an unmarked letter in the mail that gave her pause. She’d worried about the risk of anthrax, she tells TIME; of someone trying to hurt her. Eventually she gingerly opened the envelope. Inside, she found printed posters decrying gender-affirming care for children. “No child is born in the wrong body!” one read. “Who profits from this crime?”

“I was taken aback, and really kind of fearful,” Sequeira recalls. She’d seen colleagues who provided abortion receive similar abuse. But she never thought her work could become nearly as controversial. “It really made me wonder what the future of our work looks like,” she says. “Is that the path we’re going down?”

Gender-affirming care can support youth experiencing gender dysphoria, which is often described as the discomfort or distress that might occur when a person’s gender identity is inconsistent with the sex they were assigned at birth, per the Mayo Clinic. In gender-affirming care models, according to the American Academy of Pediatrics (AAP), “pediatric providers offer developmentally appropriate care that is oriented toward understanding and appreciating the youth’s gender experience.” That includes conveying the message that variations in gender identity and expression are a normal aspect of human diversity, and that, if a mental health issue does exist, it “most often stems from stigma and negative experiences rather than being intrinsic to the child.”

In young children, gender dysphoria can be treated with non-medical social and behavioral interventions, which can include allowing a child to present themselves in alignment with their gender identity by changing the way they dress, for example, or changing their given name and pronouns, explains Dr. Morissa Ladinsky, a pediatrician at the University of Alabama at Birmingham who specializes in affirming care.

After puberty has begun, a child experiencing gender dysphoria may also begin receiving gonadotropin-releasing hormone (GnRH) analogues—known by the term “puberty blockers.” They are “simply a pause button,” says Ladinsky, to stop the continued development of a puberty incongruent with a child’s gender identity.

Used at this stage, blockers are reversible, says Ladinsky, and have been used safely for over 30 years in other pediatric conditions like central precocious puberty, which causes children to enter the developmental stage too early. Puberty blockers can help “reduce distress that may occur with the development of secondary sexual characteristics” and reduce the need for surgery in the future by holding off physical changes like an Adams apple or breast growth, according to the AAP.

When they get older, some adolescents will begin taking gender-affirming hormones, such as testosterone or estradiol. While there is some debate within the medical community on when any given young person should start hormones, the intervention has proven pivotal to the treatment of dysphoria in many adolescents. It is rare for a person under 18 to undergo any type of surgical intervention, but some may decide to pursue “top surgery”—reconstructive surgery to change the appearance of one’s chest—while they are still teenagers.

An emerging body of research has found that affirming care models can result in young people having fewer mental health concerns. As with all medical care, treatment decisions are nuanced, and, because of the age of the patients, are driven by conversations between the young person, their family and their doctor. Trans and gender expansive children cannot receive affirming medical treatment without their parent’s or guardian’s consent in the U.S. healthcare system.

Yet much of the criticism surrounding gender-affirming care operates from the misperception that young children are receiving rushed, unsupervised, irreversible treatments. In violent, visceral terms, best-selling authors, right-wing commentators, conservative social-media stars, and other influential figures have made such arguments, stirring a moral panic that has grown in recent years. The Williams Institute at UCLA estimated in April 2021 that 45,100 trans youth were at risk of losing medical care if all the bills then under consideration that intended to restrict or ban gender-affirming care were implemented into law. In the same month, Arkansas went so far as to ban pediatricians from not only providing gender-affirming care, but even providing a referral to patients. (The law is currently blocked by a federal judge.) In August, Texas Gov. Greg Abbott suggested that providing affirming care to adolescents equates to child abuse.

Mis- and dis-information about trans people has also gained airtime in conservative media, especially online. A Nov. 9 report from Media Matters found that 77% of the top-performing trans-related Facebook posts between Oct. 2020 and Sept. 2021 were on right-leaning pages, as were nearly two-thirds of all the interactions on posts about trans issues.

“There’s nothing grassroots about this at all,” argues Imara Jones, journalist and founder of TransLash Media, whose podcast the Anti-Trans Hate Machine has documented the rapid rise of anti-trans legislation in recent years. “This is a highly organized movement that is targeting trans people and trans rights.”’

Jones traces the proliferation of anti-trans bills to an umbrella organization of over 60 right-wing groups called Promise to America’s Children, which lists on its website “leading national partners” including Family Policy Alliance (the lobbying arm of longtime anti-LGBTQ group Focus on the Family), Alliance Defending Freedom (which the Southern Poverty Law Center has defined as an anti-LGBTQ hate group), and conservative think tank The Heritage Foundation. She adds that the anti-LGBTQ group Family Research Council has actively promoted anti-trans bills.

Promise to America’s Children’s website includes model legislation for policymakers titled the “Protecting Children from Experimentation Act,” which aims to criminalize gender-affirming treatment for young people. A version of the bill was introduced in Congress in 2021, though it did not advance.

Leading medical organizations have decried such legislative bans. “[We] strongly oppose any effort to criminalize or penalize physicians for providing necessary care for their patients,” read a April 2021 joint press statement from AAP, the American Academy of Family Physicians, the American College of Physicians, the American College of Obstetricians and Gynecologists, the American Osteopathic Association, and the American Psychiatric Association. “Physicians must be able to practice medicine that is informed by their years of medical education, training, experience, and the available evidence, freely and without threat of punishment.”

This focus on gender-affirming pediatricians has extended beyond legislation. As disinformation and fearmongering about trans youth has surged, TIME has spoken with numerous providers who say they’ve witnessed a rise in harassment in the past two years—whether via in-person protests, online threats and cyberbullying, menacing mail, attempts to cut their research’s funding or even their medical licenses. Other gender-affirming pediatricians with whom TIME spoke refused entirely to go on the record, citing fears about the risk of violence against them and their families.

“This is shocking, shocking, shocking,” says Dr. Robert Garofalo, the head of adolescent and young adult medicine at Lurie Children’s Hospital of Chicago. “No one is prepared for this, and pediatric institutions aren’t prepared for it.”

The first known protest of gender-affirming pediatricians was in December 2020, per research by Health Liberation Now (HLN), a trans-run advocacy website that researches political impacts on trans health. But by February of 2021, anti-trans groups had announced plans to protest in Los Angeles; Chicago; Philadelphia; Dallas; Hartford, Conn.; and Ontario, Canada. Through the summer and fall of 2021, protests became a more regular occurrence. Some anti-trans groups have begun using an online interactive map that tracks the location of clinics providing gender-affirming care, per HLN’s research. Other forms of harassment stay online, but pediatricians say they are similarly frightening—and have been going on since even before the first documented in-person protest.

When Susan, a pediatric endocrinologist, got the call from her hospital’s administrative assistant in the fall of 2020, it felt like she’d been punched. (TIME is withholding Susan’s identity and that of one other provider out of concerns for their safety.) A patient’s family had contacted the hospital, the assistant said, flagging that they’d seen posts online from an account that was purporting to be Susan, but didn’t sound like her. Susan rushed to her computer, and sure enough, there was her picture and her name on a Facebook profile, apparently posting about how she regretted her treatment of transgender kids—a feeling that couldn’t be further from the truth. She found a similar fake account on YouTube pretending to be her, expressing “remorse” for her actions.

At least three other gender-affirming pediatricians were impersonated in this incident, Susan tells TIME. Their posts were made to look as if they were in conversation with each other, agreeing about the “harm” they’d done to kids.

“I don’t think I ever went into medicine thinking something like this could happen,” Susan says. “We’re always just trying to care for kids.”

Things have gotten worse. In the spring of 2021, her clinic received threats about protests. In the fall of 2021, the protests actually happened. “It really made us evaluate our safety systems for our patients, families, and staff,” she says. Susan says that she’s repeatedly been threatened with being reported to her state’s medical licensing board—though her care is not in violation of any policies—and adds that she knows gender-affirming mental-health clinicians who have faced similar harassment.

Leigh, a pediatric endocrinologist in the southeast, says people have tweeted at her asking her how she sleeps at night, arguing she is violating God’s plan.

“I am here to take care of my patients and make sure that they live longer, better, healthier lives,” she says. “And to have someone suggest something otherwise is just devastating to me.” Late at night, she’s sometimes filled with a sense of dread over where this rise in harassment could be leading. “We’ve had active shooters in the hospital where I practice for years,” she says. What if one day one of those shooters came looking for her clinic, or even her private home? “That is one of my biggest fears.”

Garofalo, of Lurie Children’s Hospital, says that at least three of his colleagues in more conservative states reached out in 2021 asking for advice on how to deal with the harassment they were facing. They’ve told him “horror stories,” he says, including instances of receiving death threats.

Dr. Brandon Hill, the former President and CEO of Planned Parenthood Great Plains, which operates in Kansas, Missouri, Oklahoma, and Arkansas, says he’s been contacted by children’s hospital administrators in major cities across the country asking what trainings he gives abortion providers to prepare them for intense backlash and harassment. “This stuff isn’t new. The tactics that these anti-trans-care folks are using have been used to [target abortion providers],” Hill explains. “[But] I don’t think we ever thought of this being something where protesters would be outside of adolescent health centers. Ever.”

In response, many gender-affirming pediatricians have banded together to be each other’s support systems. “There are definitely colleagues who have to worry more about safety than others,” says Garofalo. “We check in on each other.” They hold wellness events and share experiences.

“We’re trying to advocate and be united together,” Susan adds. “But I can see the potential for burnout.”

The stakes couldn’t be higher. A peer-reviewed study published in the Journal of Adolescent Health on Dec. 14 found that the use of gender-affirming hormone therapy (GAHT) is significantly related to lower rates of depression, suicidal ideation, and suicide attempts among transgender and nonbinary youth. The study, led by researchers at the LGBTQ suicide prevention nonprofit The Trevor Project, also found that among young trans and nonbinary people under 18, receiving GAHT was associated with nearly 40% lower odds of having had a suicide attempt in the past year. Notably, half of the transgender and nonbinary youth surveyed said they were not receiving GAHT but wanted to.

Several providers said they worry intimidation tactics could ultimately limit the health care options available to transgender and gender expansive youth, who already often face barriers to receiving care, including stigmatization, a lack of familial support, high costs, and onerous travel to reach clinics.

“We don’t need another [hurdle],” says Sequeira. “We don’t need kids to have to walk through a gauntlet of protesters to get care.”

Dr. Janet Cathey, a gender-affirming provider who treats adults and adolescents at the Planned Parenthood in Little Rock, Ark., also worries that primary care doctors considering offering gender-affirming care might choose otherwise because they don’t want to risk wading into controversial territory. In states such as Arkansas, where gender-affirming care for youth was temporarily banned in 2021, providers may feel nervous about treating trans youth because they worry it could threaten their medical license, she says.

In a research study Sequeira has been conducting over the past year, several pediatricians expressed apprehension about starting to offer gender-affirming care, she says, in part because they feared for their safety. “Which is a shame, because we so desperately need more providers in this area,” Sequeira says. A lack of available doctors doesn’t mean young people will stop needing affirmative care, adds Susan. They might just seek that care in underground ways without the supervision of a doctor, which could be dangerous.

Such an exodus has not occurred in the field of abortion providers, despite decades of dangerous attacks that include bombing, arson, and death threats, explains David S. Cohen, a professor of law at Drexel University and the author of Living in the Crosshairs: The Untold Stories of Anti-Abortion Terrorism. However, Cohen adds, many abortion clinics have been forced to close because of financial and regulatory restraints. If the trend of anti-trans legislation continues, the same could happen to gender-affirming care providers, whether or not doctors want to leave the specialty.

“The impact of this harassment is broad. It affects clinical care. It affects research. It even affects philanthropic support, which for a lot of programs has been critical,” says Garofalo, who adds that there has already been “tremendous amount of efforts to defund” his research on gender-affirming care with the National Institute of Health.

In November, the Children’s Medical Center Dallas and UT Southwestern Medical Center in Texas dissolved their six-year-old program that offered gender-affirming care to young people. (In a statement to the online news magazine LGBTQNation, the two medical centers said the decision to dissolve the program was the best option to maintain privacy for patients.) The decision came after organized protests that targeted hospital board members and argued that the care equated to child abuse, per the Texas Tribune. The program was the only one of its kind in the state.

“That’s the part that really breaks my heart about all this,” says Sequeira. “There’s a lot that’s really challenging about being an adolescent, and especially an adolescent who is finding ways to affirm their gender.”

“It just makes me so fearful to see the increasing number of protests and discrimination happening to us as providers,” she continues, “Knowing that, I can only imagine what’s happening in communities, for many, many kids.”

A wave of bills designed to limit transgender health care and participation in sports is sweeping the legislature.

Nine bills have been filed by Republican legislators that will specifically affect the transgender community. Some of the proposed legislation would put reporting requirements on professionals including teachers and doctors requiring them to out trans children to their parents.

Other bills would make it a felony to help children transition and categorize assisting a child with gender transition as child abuse. Republican legislators filing the bills say the legislation is necessary because children may undergo physical changes they later regret if they are allowed to transition.

There is a single Democrat-sponsored bill that would require death certificates to list gender identity.

Sen. Warren Petersen, R-Gilbert, said he introduced SB1138 because he is worried about kids and “somebody else making a decision for a child. It’s a decision they should be making on their own.” The bill would prevent children from being able to transition by making it illegal for health care professionals to provide gender transition medical care. Petersen said the bill was brought to him by Center for Arizona Policy President Cathi Herrod.

“Minors are undergoing these procedures and these procedures don’t really provide answers for a child that’s struggling with their biological sex,” said Herrod. She said that these children need counseling and therapy because the vast majority “grow comfortable with their biological gender over the course of growing up.”

Herrod said she also worked with Sen. Nancy Barto, R-Phoenix, on SB1165, which bans transgender women from competing on women’s athletic teams. Sen. Wendy Rogers, R-Flagstaff, has filed a similar bill. Barto’s bill passed the house in 2020 when Barto was a House member, but it died in the Senate as Covid was taking over.

Herrod does not use the term “transgender women” but said that “biological men” have physical advantages over women and calls transgender athletes the end of Title IX. “The issue that we’re addressing again is biological males identifying as females and playing on girl’s teams.” Herrod did not give an example of this in Arizona.

Herrod has worked on several bills that affect the LGBT+ community. In coming up with this legislation, she said she has heard from concerned parents and cisgender athletes, but said she only received input from one member of the gay community and would not disclose who or what their position was.

Herrod said there are two problems that need to be solved; “biological males are competing on female sports teams” and “protecting children from being given drugs and procedures that will change their lives forever… It’s not about gender identity it’s not about transition.”

Rogers introduced SB1045 that would require school administrative officials to tell a child’s parents if the child says that they may be transgender. Additionally, it prevents health care professionals from helping trans children to transition. She also introduced SB1130 that would make it illegal for health care professionals to help trans children transition and classify it as child abuse.

Rep. Cesar Chávez, D-Phoenix, said that he came out to his school counselor before his family for fear of being displaced from his home. He said of the SB1045, “just imagine what that would do if that got to a parent who potentially doesn’t understand… We’ve seen youth displaced from their home, we’ve seen youth suffer from violence.”

Chávez said the gravest ramification of outing children to their families is suicide. According to a survey by the Trevor Project in 2021, 72% of trans youth considered or attempted suicide with the majority under the age of 18 compared to 42% of LGBT+ cisgender youth. Rogers did not respond to questions about her bills – SB1045 and SB1046.

On the other side of the aisle, SB1186 was filed by Sen. Rosanna Gabaldon, D-Green Valley, and would require death certificates to record the deceased’s gender identity. Sen. Raquel Teran, D-Phoenix, said that if there are not more “proactive” bills being introduced by the Democrats it is because they are in “defense mode.”

At a press conference over Zoom on January 18, the LGBTQ caucus headed by Chávez, and the HRC Foundation spoke about these bills and the “anti-LGBTQ agenda” at the state Legislature. “This is an attack on human rights. We’re criminalizing individuals for being who they are,” said Chávez. “The LGBTQ caucus will continue to fight against these bills.”

Chávez said he will hold meetings with stakeholders, have conversations across the aisle and get testimony from families of transgender people. That being said, the Democrats who generally oppose these bills are in the minority in both the House and Senate.

Member of the HRC Foundation’s Parents for Transgender Equality National Council Lizette Trujillo is a parent of a trans child in Tucson and spoke at the press conference. “These bills dehumanize our loved ones … This causes irreparable harm on the transgender community.”

Former HRC national board member, current physician and transgender woman Dr. Bobbi Lancaster has spoken against similar bills for years, and she disagrees with a suggestion in one bill that trans individuals continue to suffer psychiatric symptoms after transition.

“The insinuation is that the procedures and hormones should never have been done, and that there is regret,” Lancaster said. “Nothing could be farther from the truth… I wish the lawmakers would stop using this marginalized group as pawns, to remain in power, and get on with representing their constituents and solving real problems.”

All but two of these bills have been assigned to committees. Three of the bills will be heard in the Senate Judiciary Committee. SB1165 was passed by the committee Thursday.

There are no gay or trans members of the Senate and no trans members of the House or any higher office position. The three members of the Legislature’s LGBT+ caucus are cisgender Democratic men in the House.

Four bills were filed in the House by Rep. John Fillmore, R-Apache Junction, and six bills were filed in the Senate. The LGBTQ caucus has three members in the legislature: Rep. Chávez, Rep. Robert Meza, D-Phoenix, and Rep. Daniel Hernandez, D-Tucson. There are no LGBTQ caucus members in the Senate and no transgender legislators in Arizona.

Former political director of Equality Arizona Brianna Westbrook said that bills like this are the reason she is currently running for a seat in the Legislature. “There is not a voice at the state Legislature that is trans and as a state representative that is something that I will actively push back on … To call these bills what they are they’re transphobic and they hurt people.”

She couldn’t read the labels. She could barely reach them. I offered to help.

After I handed her the raspberry preserves, she thanked me, paused, and then asked, “Do you know why I buy this brand?”

I laughed and replied, “Because it tastes good?”

“Yes, it tastes good.” She paused again. “I am a Holocaust survivor.”

This was not the conversation I expected on a Sunday grocery run. “During the war, the family that owns the company hid my family in Paris. So now I always buy it. And whenever I go to the store, my grandkids remind me, ‘Bubbe, don’t forget to buy the jelly.’”

I told her that that was the best reason I ever heard to buy any company’s product. And then we both smiled behind our masks and went our separate ways.”

File Civil Rights complaints at the Health and Human Services website – Section 1557 of the Affordable Care Act (‘ObamaCare’) protects against Sex Discrimination.

Don’t spend ANY time worrying about whether the ACA applies in your case.  Assert that this is Sex Discrimination, because it is.  They will figure out whether the ACA applies in the particular case.  If people do not file, HHS doesn’t know what is going on.

Such complaints wouldn’t have been beneficial under Croooked Drumpf and Republi-cons.  We are in a different place now.  For now.  Use it!

A Republican lawmaker admitted in public that the entire point of his “religious freedom” is to legalize discrimination against LGBTQ people.

For years, LGBTQ advocates have argued that religious exemptions – either passed through legislation or created in court decisions – would effectively legalize discrimination against LGBTQ people. Christian conservatives have refused to publicly admit it, claiming that such exemptions would “protect” Christians’ religious freedom without leading to discrimination.

But now Virginia State Sen. Mark Peake (R) was caught saying the quiet parts out loud while discussing his proposed S.B. 177, a bill that would create a religious exemption to the state’s ban on discrimination in housing, allowing a “religious corporation, association, or society, or any nonprofit institution or organization” to refuse to provide housing to people who they believe don’t follow their “religious principles.”

“You are correct, what you said is correct,” Peake said in a committee hearing. “They would be allowed to discriminate against people that they do not feel follow their religious beliefs.”

“This is the whole point of it, is for their religious beliefs, and it gives them the ability to discriminate against people that conflict with their religious beliefs.”

“I think that is the substance of this bill,” he said, laughing.

Religious conservatives have a long history of denying that their demands for religious exemptions will lead to discrimination against LGBTQ people and religious minorities, insisting that businesses and non-profits can refuse to serve people they don’t like without it really being discrimination.

One of the most famous examples of this refusal to acknowledge basic reality was an interview then Indiana Gov. Mike Pence did with ABC’s George Stephanopoulos in 2015. When Stephanopoulos asked Pence if Indiana’s religious exemptions bill would allow discrimination against gay couples, Pence said no and responded that the bill is for “protecting… the religious liberty of Hoosiers.”

The Virginia Senate General Laws and Technology Committee rejected S.B. 177 in an 8-7 vote.

‘I will never be considered human’: the devastating trauma LGBTQ+ people suffer in religious settings

As the government prepares to push through its controversial religious discrimination bill this week, serious questions have been raised about protections for gay and transgender students in faith-based schools.

It comes after Citipointe Christian College in Brisbane faced criticism for sending enrolment contracts to parents with gender and sexuality clauses comparing homosexuality to bestiality and paedophilia. The contract was revoked and the principal has stood aside.

Another private Sydney school also came under fire for a “statement of faith” with its enrolment applications that listed same-sex relationships and transgender identity as being “not acceptable to God”.

These schools are not attempting anything new. The practice of excluding LGBTQIA+ people from religious spaces has a long, winding history.

Analysis of the world, from experts

As a gay man and pastor who previously held a conservative view, I wanted to undertake research to understand the experiences of people who have navigated this complex terrain. I interviewed 24 LGBTQIA+ people who had all spent time in a range of conservative Christian denominations, many of whom had grown up attending religious schools.

You could be forgiven for thinking LGBTQIA+ communities and the church are (as one of my participants said) “like oil and water” – never the two shall mix. But as many as 32% of same-sex couples in Australia identify as Christian, and increasingly, LGBTQIA+ Christians are having their voices heard.

The stories from the participants in my research are, almost across the board, vivid depictions of religious trauma.

Understanding religious trauma

Religious trauma has been defined as “pervasive psychological damage resulting from religious messages, beliefs and experiences”.

Picture the teenage student at a faith-based school who has experienced a dawning realisation they are not neatly heterosexual. In this kind of environment, the student might be told on a regular basis their sexuality is broken and it is a source of shame or the work of Satan. They are warned against ever experiencing intimacy because doing so would be an indication they are not saved and are destined for Hell.

According to my participants, words to this effect are spoken gently by chaplains in the corridors, loudly by peers on the playground and formally by executive staff in the office. Gay people are compared with murderers. Trans people are depicted as threats to the order of society.

Parents absorb these messages and reinforce them, either explicitly or by their resounding silence.

In my research, one participant recounted a talk she heard at a church youth group as a teenager, just as she was just coming to terms with her sexuality.

It was a talk just about relationships […] and point seven of 15 was ‘being gay is not real’. It was such a confronting thing to hear when I was just at the pinnacle of realising what was happening for me, here was someone saying it doesn’t even exist. ‘It’s a disease that can be healed.’

Another young man talked about the trauma of his teenage years when he was forced to attend counselling.

That was probably the lowest point that it ever got, because it was just a constant barrage of being told that I am horrible, that I am never going to amount to anything in life. And because of this small difference, I will never be considered human, never be considered like everybody else, never be loved, never be accepted, never have a wife.

I asked another young woman what she would like Christian leaders to understand. She replied:

They are not being driven to the edge of suicide because of what they believe, but I am, because of how they have treated me.

My research found LGBTQIA+ people may encounter dozens, or even hundreds of these moments, in any given week or month in their daily lives. These are moments when the individual recognises they are not in a safe environment.

Over time, large and small moments like this (often referred to as microaggressions) accumulate and a person’s mental health almost inevitably deteriorates. Research shows young queer people exposed to religiously motivated messages are alarmingly more likely to express thoughts of self-harm and suicidal ideation.

What queer Christians need to feel safe

By virtue of being part of a marginalised community, queer Christians don’t necessarily have the benefit of social supports and protective factors available to the broader population.

The very people who should be providing safety and protection (their parents, teachers and pastors) are, in many cases, actually inflicting the harm. Behavioural scientists recognise this experience as a form of minority stress. As one participant shared,

When you’re in a Christian school, the last thing that you expect is full-on bullying from your own Christian teachers and leaders. They are the ones that you want to reach out to for help, but they were the last people that I wanted to go to and the last people that I felt safe around.

All of this is built on an interpretation of the Bible that asserts God designed all humans to be straight and cisgender – anything else is a form of “brokenness”.

It is important to note, however, some of the most critical voices against Citipointe have been other Christians (many of them connected with the school).

This is testament to a large (and growing) portion of the church which has sought to understand the Bible in light of scientific research into the nature of gender and sexuality.

Legislative solutions are only one remedy to the complexities of LGBTQIA+ exclusion. As a society, we must continue to seek to understand these issues without falling into the “Christians versus queer community” trap.

And while identifying these experiences as trauma is vital, the path to healing can only come when queer people feel safe to connect in faith communities without threat of exclusion. Religious leaders must now grapple with how to navigate this path. Change is happening, but the path to inclusion is far from complete.

In a humiliating rebuff to Scott Morrison, a revolt by Liberal backbenchers has struck down the provisions of the sex discrimination act that allow discrimination against gay and transgender children.

In the early hours of Thursday, five Liberals crossed the floor – Katie Allen, Dave Sharma, Trent Zimmerman, Bridget Archer and Fiona Martin – in defiance of the Prime Minister. The vote was 65-59. The amended bill then passed the House of Representatives and now has to go to the Senate.

The rebels had been concerned the government’s much narrower proposed change excluded transgender children at religious schools.

The amendment was moved by crossbencher Rebekha Sharkie and was identical in wording to one of Labor’s proposed amendments. Sharkie told The Conversation she thought it might have a greater chance of success coming from the crossbench.

Earlier Morrison had told the house there would be “a time and place” to address the situation of transgender children.

He said the Law Reform Commission would consider the protection of these children from discrimination while allowing schools to maintain their ethos. The commission would report in six months. He also named Allen as chair of a House of Representatives select committee on the question.

The government’s proposed change to the sex discrimination legislation was a parallel bill to its religious discrimination legislation.

Labor and two Liberal rebels narrowly failed to amend the religious discrimination bill when Speaker Andrew Wallace used his casting vote to break a tied vote.

Archer and Zimmerman crossed the floor to support a Labor amendment aimed at ensuring existing anti-discrimination protections were not diminished by the protection to be given to “statements of belief”. The vote was 62-62.

The religious discrimination bill passed the house at 4am Thursday, shortly before the revolt over the associated bill. The only amendments to it were those the government made.

Archer, who supported all Labor’s amendments to the religious discrimination bill, also voted against its second reading and its final passage.

Now that they have been lost in the lower house, the opposition will pursue its amendments to the religious discrimination bill in the Senate.

Labor on Wednesday gave support to the controversial bill but said it was flawed and should be amended.

Caucus approved a package of proposed amendments that would

prohibit religious vilification

make it clear the legislation’s “statement of belief” did not remove or diminish existing protections against discrimination. (The legislation provides that “statements of belief” are legally protected if based on a genuinely held religious view.)

During the House of Representatives debate opposition leader Anthony Albanese tabled a letter Morrison had sent to him late last year in which the PM reaffirmed “there is no place in our education system for any form of discrimination against a student on the basis of their sexuality or gender identity” and said the government would amend the sex discrimination act to remove the provisions allowing this.

Labor said that it would “insist” on any of its amendments that were passed in either house. That could mean, if the government refused to accept them, the legislation bouncing between the houses until one or other side gave way.

The religious discrimination legislation is up against the clock, with the Senate rising on Thursday, and not sitting again until budget week, the last sitting before the election.

Albanese told parliament the legislation was “flawed” but it could be fixed.

He said it should be possible “to enhance protections against discrimination without enhancing discrimination against others”.

“We need shields from discrimination, not swords for discrimination.” He said the legislation should be a unifying moment.

But if not amended the bill “will only succeed in driving us apart,” Albanese said.

Morrison has been pulling out all stops to get the religious discrimination legislation through.

But moderate Liberals have had a range of concerns, and much effort had gone into trying to settle backbench doubts and minimise defections.

Zimmerman told the house that he would “part with my party” on the statement of belief provision and the changes to the sexual discrimination act.

Zimmerman said the statement of beliefs “puts religious faith on a pedestal above other rights”. He objected to the changes to the sex discrimination act failing to include protection for teachers and transgender children.

NSW Treasurer Matt Kean tweeted “Trent Zimmerman has been one of my greatest political heroes during my 20 years in the Liberal party. This speech will help everyone understand exactly why.”

Earlier, NSW premier Dominic Perrottet said of the religious discrimination legislation: “I’ve made it very clear that I don’t believe legislation in this space is necessary”. He said it could end up creating more problems than it solved.

Within the Labor frontbench, and in the wider caucus, there was division about over whether the opposition should pursue amendments or oppose the legislation outright.

Former Labor leader, Bill Shorten, who was reported to have argued in shadow cabinet that Labor should oppose the legislation, told the house, “We will rue the day if this legislation passes the Senate” .

Costco carries this jam and I felt that this story needed to be shared.

The incident took place in a supermarket in New Jersey. The tweet is by Michael Perino @ProfessorPerino

“At the supermarket today, I found a small, elderly woman standing in front of a high shelf holding @BonneMamanUS preserves. She was having trouble finding the flavor she wanted because the jars were set back on the shelf.

She couldn’t read the labels. She could barely reach them. I offered to help.

After I handed her the raspberry preserves, she thanked me, paused, and then asked, “Do you know why I buy this brand?”

I laughed and replied, “Because it tastes good?”

“Yes, it tastes good.” She paused again. “I am a Holocaust survivor.”

This was not the conversation I expected on a Sunday grocery run. “During the war, the family that owns the company hid my family in Paris. So now I always buy it. And whenever I go to the store, my grandkids remind me, ‘Bubbe, don’t forget to buy the jelly.’”

I told her that that was the best reason I ever heard to buy any company’s product. And then we both smiled behind our masks and went our separate ways.”

Someone else on Twitter looked into the story and indeed, the town that Andros Company, the makers of Bonne Maman, comes from, hid and saved Jewish families in WW2. It was called Biars sur Cere, which then had about 800 villagers.

From an article, “You have to understand what it was like then. There were posters on the walls, from the Nazis and from the collaborators, and they said that if you are found to help a Jew, a freemason, a communist, a socialist, or a pervert, you will be shot on sight.” Despite the great danger in which helping them put the villagers in, still they kept the children safe.”

A good reason to buy Bonne Maman products. And a poignant reminder that when we look out for each other it can change lives, and that there are good and selfless people in the world.

File Civil Rights complaints at the Health and Human Services website – Section 1557 of the Affordable Care Act (‘ObamaCare’) protects against Sex Discrimination.

Don’t spend ANY time worrying about whether the ACA applies in your case. Assert that this is Sex Discrimination, because it is. They will figure out whether the ACA applies in the particular case. If people do not file, HHS doesn’t know what is going on.

The state must pay the costs of a welfare recipient’s sex change operation, the California Court of Appeal ruled Thursday in two similar cases.

In both, the state health director had refused to authorize Medi-Cal to pay for the proposed transsexual surgery on grounds it would be cosmetic surgery.

One case involved a man, identified as G.B., and the other involved a woman, identified as Jane Doe.

The state had refused to authorize G.B.’s surgery because, the director said, the operation as described by G.E.’s doctor would be “a cosmetic operation that would change the appearance of the claimant’s external genitalia.

“Inasmuch as the proposed operation is to be performed solely for that purpose, it must be considered a cosmetic operation that is not covered under the Medi-Cal program,” the director said.

But in 2-1 rulings Thursday, the court said the only evidence presented was that surgery was necessary and reasonable.

“We conclude,” the court said, “that the proposed surgery cannot be arbitrarily classified as cosmetic and inasmuch as this was the sole basis of the director’s decision, his decision must be and is hereby set aside.”

It sent the cases back to San Francisco Superior Court with orders that the state be directed to grant authorization for surgery.

G.B. in 1975 consulted plastic surgeon Dr. John Brown who diagnosed him as suffering from “gender identity dysphoria or transsexualism,” said the court.

“Dr. Brown determined it was medically necessary and reasonable to peform surgery, which would involve the removal of the male sex organs and construction of female genitalia.”

Brown’s treatment authorization request was denied by a San Francisco Medi-Cal field office consultant. After a hearing, a health department referee ordered the authorization be granted, but the director reversed it.

Jane Doe was born physically a male Jan. 1, 1948, but at a very early age developed many female characteristics which, the court said, “became more obvious as she grew older.”

The court said she had been living completely as a woman since 1968 and had experienced job problems because of her failure to undergo physical examinations, had severe depression and finally sought medical help in 1969.

Treatment authorization was initially denied, then granted by a referee and reversed by the director.

“We believe we are required to rule on these two cases on the evidence, not on the basis of a whimsical decision of the director,” said the majority, Justices Richard Abbe and Sidney Feinberg. “We do not believe, by the wildest stretch of the imagination, that such surgery can reasonably and logically be characterized as cosmetic.”

The Health Department cited a 1974 Medi-Cal bulletin saying medical services for diagnostic workup, surgical procedure, hormonal therapy or psychiatric care involved in (Continued on A-3, column 1)

The court said there is no dispute G.B. is an adult male transsexual and cited expert testimony that psychotherapy had not solved the problem and successful treatment would involve radical sex conversion surgery.

The court noted the Health Department’s definition of cosmetic surgery requires that It be “considered by the average prudent observer to be within the range of normal and acceptable appearance for the patient’s age and ethnic background,” the court said.

“The average prudent observer probably has no desire and will not observe what is under the skirts or trousers of either a pre-op or postoperative transsexual,” the court added. “It is not a generally recognized characteristic of transsexuals to move about in public in the nude.

“It is clearly impossible to conclude that transsexual surgery is cosmetic surgery,” the decision said.

The dissent by Justice James Scott held that the director acted within his descretion in refusing to extend the Medi-Cal benefits.

Scott called the decision a “dangerous course of judicial intermeddling with the policy decisions” of the Health Department and added if such operations must be funded,

“Med-Cal will be forced to authorize other surgical treatments as ‘cures’ for neuroses.”

In 2021, Arkansas passed a law banning gender-affirming healthcare for trans young people. This discriminatory law would not only prohibit healthcare professionals from providing or referring trans young people under 18 for medically necessary health care, it would also allow private insurers to refuse to cover gender-affirming care for trans people of any age. If it is allowed to go into effect, the law will undermine the mental, emotional, and physical health of transgender and non-binary people across the state.

Though the ACLU has won a temporary pause on Arkansas’ health care ban, the fight continues in federal appeals court and in statehouses around the country, which is why trans stories are so important. While Arkansas is the first — and so far, only — state to pass such legislation, similar bills have been introduced in over 30 states around the country.

An amazing 58 transgender and non-binary adults including actor Elliot Page, activist Miss Major Griffin-Gracey, media personality Jazz Jennings, state senator Sarah McBride, and filmmaker Lilly Wachowski have stood up in defense of ACLU’s clients. They shared their stories in a “friend of the court” amicus brief filed by the Transgender Legal Defense & Education Fund (TLDEF) and Cleary Gottlieb Steen & Hamilton LLP in support of plaintiffs in the ACLU’s case in the U.S. Court of Appeals for the Eighth Circuit, Brandt v. Rutledge.

Read their stories below about how gender-affirming care has changed their lives for the better, the hardships of gender dysphoria, and the joys of transitioning.

Trans young people know who they are.

North Carolina-raised film producer Rhys Ernst remembers: “One of my earliest conscious memories, in which I felt the most alive and like myself, was at age 3, when I realized quite clearly that I was a boy. I felt a strong jolt of purpose and belonging claiming that identity for myself.”

Jazz Jennings from Florida, now a 21-year-old student, started gender-affirming treatment when she began puberty and then went on to receive gender-affirming hormones. She told the court how having a typical female puberty helped her: “I developed alongside my peers as a female teenager. I was able to lead a happy childhood because I was able to live as the girl I knew I was.”

Noted transgender activist Major Griffin-Gracy, an Arkansas resident who is now over 70, first began receiving gender-affirming care in the form of hormones when she was 16 years old. While the discrimination she has faced as a transgender woman has made her life challenging, she reflects that receiving hormone treatment as a teen “made life easier than it would have been.”

Gender-affirming care helps trans people thrive

Amici Dr. Gwendolyn Herzig of Alexander, Arkansas owns and operates an independent pharmacy. She shared with TLDEF how much coming into her identity empowered her to take a leadership role in the community:

“Living authentically has allowed me to better stand up and provide support for minority communities that need it the most. Especially, being the only trans female pharmacy owner in Arkansas, and maybe the South, in the face of a pandemic, I have been able to provide immunizations, resources, and guidance. Before, it was easier to hide away and to cope day by day. Now I try to take each day by storm and help everyone I can!”

Gender-affirming care cemented Beck Witt Major’s relationship with his father.

“A gender-affirming therapist helped our whole family come to terms with what was happening, and I think helped my dad the most,” he told TLDEF. “Before he passed, he loved and accepted me totally and would even send me cards saying things like Happy Birthday, Son.”

While his transition began in adulthood, Elliot Page agreed, sharing how his life completely changed once he was able to receive top surgery. “I couldn’t believe the amount of energy I had, ideas, how my imagination flourished, because the constant discomfort and pain around that aspect of my body was gone,” Page told the court.

Team USA athlete Chris Mosier recalled his first triathlon race after top surgery as a moment of gender euphoria: “The feeling of being able to run freely in a body that more closely matched the way I’ve always seen myself was overwhelming.”

Trans young people know what they need

Overall, the story told by this incredible array of transgender and non-binary supporters is that the treatment for gender dysphoria — gender affirmation — works.

Cecilia Gentili, a 49-year-old small business owner and transgender rights advocate, first received self-managed gender-affirming care at age 17, which she said was “great” and “changed her life,” but would have been even more beneficial if she had been able to obtain it through a doctor, rather than on her own. Gentili told the court:

“Transgender youth know who they are, and they know what they need. Our job is to listen to them.”

Transgender Legal Defense & Education Fund is committed to ending discrimination based upon gender identity and expression and to achieving equality for transgender people through public education, test-case litigation, direct legal services, and public policy efforts.

Someone else on Twitter looked into the story and indeed, the town that Andros Company, the makers of Bonne Maman, comes from, hid and saved Jewish families in WW2. It was called Biars sur Cere, which then had about 800 villagers.

There were posters on the walls, from the Nazis and from the collaborators, and they said that if you are found to help a Jew, a freemason, a communist, a socialist, or a pervert, you will be shot on sight.” Despite the great danger in which helping them put the villagers in, still they kept the children safe.”

A good reason to buy Bonne Maman products. And a poignant reminder that when we look out for each other it can change lives, and that there are good and selfless people in the world.

Dear Reader:

History repeats itself.  Those who fail to recognise historical disasters are doomed to repeat them.

Today’s world is repeating the events of a century ago.

Please bear in mind Hitler’s Three Stages to Genocide – his Final Solution for Jews, Roma, Communists, Socialists, Trade Unionists.  And Our Trans and LGBT Community:

 – You have no Rights,
 – You have no Rights to live amongst us,
 – You have no Rights to live.

I’ve been on a roll during recent months pointing out how Trans and LGBT were as much targets of Hitler and NAZIs as any other vulnerable ethnic, political, or social group, but are forgotten because we are the bottom of the list where few others care about our existence – we were not even allowed freedom when Eisenhower and Patton Allied forces ‘liberated’ Hitler extermination camps from NAZI control.  Look at all this year’s state legislation against Trans Rights, against our very Rights to exist.  I call attention to the last 100 years of worldwide attack.

Bear in mind how much Hitler and NAZIs minimised the Trans and Lesbian Communities throughout the Shoah Holocaust era.  Bad enough that Hitler targeted Gay men, Trans and Lesbians were relegated to diminished concern – no recognition by name, their extermination all too real.

Hitler’s Three Stages to genocide fullfilled:  NAZI ideology declared that Trans people lacked humanity, not worth existing as people, therefore, NAZIs felt no twinge of conscience (1) when they denied Rights to Trans people (Paragraph 175), (2) when they segregated Trans people to concentration camps, (3) when they annihilated Trans people at Hitler’s extermination camps.  Dora Richter perished at a NAZI extermination camp.

‘Hitler declared Emergency Rule and suspended all Civil Rights and constitutional protections, providing the basis for arbitrary police action.  Political opponents could be beaten, terrorised, and held indefinitely.  Trade Unionists were arrested.  Hitler sent thousands to concentration camps.

Allied Forces, led by such notable Amerikan Fascists as Eisenhower and Patton, were no different in their hatred of the Trans population as were Hitler and his NAZIs.

Fact:  Hitler targeted Trans people for his Final Solution, for annihilation at his extermination camps.

Fact:  Allied Forces continued Hitler’s orders – to hold Trans persons captive amidst dire conditions after the otherwise supposed ‘Liberation’ of Hitler’s extermination camps – conditions far worse than under the defeated NAZI command.  Allied Forces mal-treatment of Trans and LGBT prisoners’ continued imprisonment led to thousands more deaths of those Trans and LGBT civilians

Fact:  Allied Forces did take NAZIs into custody following the defeat of NAZI Germany, then ‘liberated’ those countless NAZI prisoners, despite continuing to hold Trans and LGBT civilians captive, to perish at Hitler’s extermination camps while NAZI war criminals went free.

In October 2018 the Facebook community page for a popular online comedy series brought attention to the horrific treatment LGBTQ Germans received not only during World War II, but afterwards.

“An estimated 15,000 gay people were incarcerated in Nazi concentration camps,” the post on the Lizzy The Lezzy page stated. “It’s unclear on how many died once in the camps.”

The post was accompanied by a picture of a pink triangle — the symbol officials in Nazi Germany used to identify and ostracize gay concentration camp prisoners — and a quote drawn from the website for The Pink Triangle of San Francisco, an annual event remembering those victimized under Nazi rule:

At the end of the war, when the concentration camps were finally liberated, virtually all of the prisoners were released except those who wore the pink triangle. Many of those with a pink triangle on their pocket were put back in prison and their nightmare continued.

Both claims made in the post are accurate, according to the United States Holocaust Memorial Museum:

Between 1933 and 1945, an estimated 100,000 men were arrested for violating Nazi Germany’s law against homosexuality, and of these, approximately 50,000 were sentenced to prison. An estimated 5,000 to 15,000 men were sent to concentration camps on similar charges, where an unknown number of them perished.

But even though the U.S. and their allies defeated the Nazi regime, the law remained in effect after World War II, as the Holocaust Memorial museum’s exhibit on the regime’s anti-gay persecution states:

As the Allies swept through Europe to victory over the Nazi regime in early 1945, hundreds of thousands of concentration camp prisoners were liberated. The Allied Military Government of Germany repealed countless laws and decrees. Left unchanged, however, was the 1935 Nazi revision of Paragraph 175. Under the Allied occupation, some homosexuals were forced to serve out their terms of imprisonment regardless of time served in the concentration camps. The Nazi version of Paragraph 175 remained on the books of the Federal Republic of Germany (West Germany) until the law was revised in 1969 to decriminalize homosexual relations between men over the age of 21.

After the war, the Allies chose not to remove the Nazi-amended Paragraph 175. Neither they, nor the new German states, nor Austria would recognise homosexual prisoners as victims of the Nazis – a status essential to qualify for reparations. Indeed, many gay men continued to serve their prison sentences.

People who had been persecuted by the Nazis for homosexuality had a hard choice: either to bury their experience and pretend it never happened, with all the personal consequences of such an action, or to try to campaign for recognition in an environment where the same neighbours, the same law, same police and same judges prevailed.

Unsurprisingly very few victims came forward. Those who did, even those who had survived death camps, were thwarted at every turn. Few known victims are still alive but research is beginning to reveal the hidden history of Nazi homophobia and post-war discrimination.

Weimar Germany’s major urban centers had very active LGBT scenes between World War I and World War II. Clubs such as Berlin’s El Dorado, on which the movie Cabaret was loosely based, thrived. At the Institute of Sexual Science, doctors and scientists studied the various manifestations of human sexuality and worked to convince society that same-sex attraction was natural and not a “perversion.” So vibrant was the culture that there were over 30 homosexual periodicals published with a total readership of roughly one million people across Germany. The Nazi Party drove all of this vibrant culture back under ground when they came to power in 1933.

The Nazis viewed homosexuality as a degeneracy and a vice that weakened the German nation. Moreover, it was believed that gay men and women had a tendency to form cliques and could potentially establish a “state within a state,” thereby undermining the authority of the Third Reich. According to Nazi leadership, the most pressing threat posed by homosexuality was that it robbed the German nation of “racially-pure” offspring.

NEVER AGAIN? IT’S HAPPENING AGAIN

After the Second World War, during which many millions were systematically, industrially, gruesomely murdered in the worst genocidal crime against humanity, the earnest, global, unison cry was, ‘Never again’.

Those two words summed up the sincere, solemn feeling and resolve of a world shocked, numbed and reeling from the discovery that so many had been so callously rounded up and brutally murdered.

Not for anything they had done.  But simply for who they were.

Mostly Jews, but also gypsies, homosexuals, the disabled…and others, many others.

Millions.  Murdered.  With the goal to wipe them out.  Men, women, children, babies.  Mass murdered.  Destroyed.  Deleted.

Never again.  That was the response.  Never again.  Never again.

The means to achieve this noble intention was set in motion immediately.

Costco carries this jam and I felt that this story needed to be shared.

The incident took place in a supermarket in New Jersey. The tweet is by Michael Perino @ProfessorPerino

“At the supermarket today, I found a small, elderly woman standing in front of a high shelf holding @BonneMamanUS preserves. She was having trouble finding the flavor she wanted because the jars were set back on the shelf.

She couldn’t read the labels. She could barely reach them. I offered to help.

After I handed her the raspberry preserves, she thanked me, paused, and then asked, “Do you know why I buy this brand?”

I laughed and replied, “Because it tastes good?”

“Yes, it tastes good.” She paused again. “I am a Holocaust survivor.”

This was not the conversation I expected on a Sunday grocery run. “During the war, the family that owns the company hid my family in Paris. So now I always buy it. And whenever I go to the store, my grandkids remind me, ‘Bubbe, don’t forget to buy the jelly.’”

I told her that that was the best reason I ever heard to buy any company’s product. And then we both smiled behind our masks and went our separate ways.”

Someone else on Twitter looked into the story and indeed, the town that Andros Company, the makers of Bonne Maman, comes from, hid and saved Jewish families in WW2. It was called Biars sur Cere, which then had about 800 villagers.

From an article, “You have to understand what it was like then. There were posters on the walls, from the Nazis and from the collaborators, and they said that if you are found to help a Jew, a freemason, a communist, a socialist, or a pervert, you will be shot on sight.” Despite the great danger in which helping them put the villagers in, still they kept the children safe.”

A good reason to buy Bonne Maman products. And a poignant reminder that when we look out for each other it can change lives, and that there are good and selfless people in the world.

Don’t spend ANY time worrying about whether the ACA applies in your case. Assert that this is Sex Discrimination, because it is. They will figure out whether the ACA applies in the particular case. If people do not file, HHS doesn’t know what is going on.
